A simple dictionary definition of Patent means a grant made by a Government which confers upon the creator of an invention the sole right to make, use, and sell that invention for a period of time.
In Nigeria, The National Office for Technology , Acquisition and Promotion (NOTAP) is responsible for patenting all inventions and innovations carried in the Public or Private Sectors.
When a new business idea springs up in our head, especially in this part of the continent, the last thing that will ever come to mind is Patenting. Some Business Elite don't even understand why you need a Patent Right in Nigeria, not to talk about the regular every day market man or woman.
The idea conceived within the confines of your room can end up being the best thing the world has ever seen or heard of. It has been observed that we unconsciously do not have the culture of Patenting our inventions,creations or designs, until some body else steals the idea, then we instantly realise how we did it first. Whose fault is it then?
There is one thing that comes to my mind every time i see someone wearing this particular lovely Coral necklace at events, if only the person that came up with this design inside Balogun Market in Lagos Island got a good Legal Advise on this particular design, he/she would have been swimming in big bucks right now. It seems like every where I turn this particular piece of jewelry follows me every where, its so bad that even those that try to do a better version of this design always end up like the original design.Although in the case of a jeweler, Copyright would be the ideal thing to do.
